1. Overview
This Privacy Policy explains how ViTuber Technologies Private Limited ("ViTuber", "we") collects, uses, stores, shares, and protects your personal data when you use the ViTuber platform.
This policy applies globally and complies with the Digital Personal Data Protection Act 2023 (India), the General Data Protection Regulation (EU/UK), and other applicable privacy laws.
2. Data We Collect
Account data: Name, email address, username, password hash, profile picture, bio.
Usage data: Videos watched, watch duration, search queries, likes, comments, subscriptions, clips viewed.
Device & technical data: IP address, browser type, operating system, device identifiers, PWA install status, approximate location (country/region from IP).
Payment data: Billing name, last 4 digits of card, billing address, transaction IDs. Full card numbers are never stored — processed by Razorpay.
Creator data: Channel analytics, earnings, payout bank details (encrypted), referral activity.

3. How We Use Your Data
We use your data to: (a) provide and personalise the Platform; (b) process payments and manage subscriptions; (c) send service-related communications (account security, billing receipts, policy updates); (d) analyse platform usage and improve features; (e) detect and prevent fraud, abuse, and policy violations; (f) comply with legal obligations; (g) respond to support and grievance requests.
Legal basis (GDPR): Contract performance (account, payment), legitimate interests (security, analytics), consent (marketing emails, non-essential cookies), legal obligation (government requests, IT Act compliance).
5. Data Retention
We retain your data for as long as your account is active or as needed to provide services. Specific retention periods:
Account data — until account deletion + 30 days. Payment records — 7 years (statutory requirement). Video content — until you delete it or your account. Analytics — 26 months (Google Analytics default). Server logs — 90 days.
After account deletion, personal data is purged within 30 days except where retention is legally required.
6. Your Rights
Depending on your jurisdiction, you have the right to:
Access — request a copy of your personal data.
Correction — update inaccurate data (most data is editable in Settings).
Deletion — request deletion of your account and associated data.
Portability — receive your data in a structured, machine-readable format.
Restrict processing — ask us to stop using your data for specific purposes.
Withdraw consent — for activities based on consent (e.g. marketing emails, analytics cookies).

7. Security
We implement industry-standard security measures including TLS 1.2/1.3 encryption in transit, AES-256 encryption at rest for sensitive fields, Argon2id password hashing, JWT access tokens with short expiry, rate limiting, and regular security audits.

8. International Transfers
Your data may be processed on servers in India, the EU, and the US. For transfers outside India, we rely on Standard Contractual Clauses (SCCs) or equivalent safeguards recognised under the DPDP Act 2023 and GDPR.
9. Children's Privacy
ViTuber is not directed to children under 13. We do not knowingly collect personal data from children under 13. If we become aware of such collection, we will delete the data immediately. Parents/guardians may contact [email protected].
10. India — DPDP Act 2023 Compliance
ViTuber acts as a Data Fiduciary under the Digital Personal Data Protection Act 2023. We process personal data based on free, specific, and informed consent obtained at account registration, or on legitimate uses as defined under the Act.
