1. Overview
ViTuber complies with the Digital Millennium Copyright Act (DMCA), the Information Technology Act 2000 (India), and applicable international copyright laws. We have a policy of removing content that infringes third-party copyrights and terminating the accounts of repeat infringers.
We have registered a Designated Copyright Agent with the US Copyright Office as required for DMCA safe harbour protection.
2. Submitting a Takedown Notice (DMCA)
If you believe content on ViTuber infringes your copyright, send a written notice to our Designated Agent containing all of the following:
1. Your full name, address, telephone number, and email address.
2. A description of the copyrighted work you claim has been infringed.
3. The URL(s) of the infringing content on ViTuber.
4. A statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner.
6. Your physical or electronic signature.

We will act on valid notices within 24 hours for CSAM and 48โ72 hours for other copyright complaints.
3. Counter-Notice
If your content was removed due to a DMCA notice and you believe it was removed in error, you may submit a counter-notice to [email protected] containing:
1. Your name, address, telephone number, and email address.
2. Identification of the removed content and its URL before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief the content was removed due to mistake or misidentification.
4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district where you reside (if in the US), or the courts of Bengaluru, India (if outside the US).
5. Your physical or electronic signature.
Upon receiving a valid counter-notice, we will notify the original complainant and restore the content within 10โ14 business days unless the complainant files a court action.
4. Repeat Infringer Policy
Under our repeat infringer policy, accounts that receive 3 or more valid copyright strikes within any 12-month period will be permanently terminated. Appeals may be submitted to [email protected].
5. India โ IT Act 2000 (Takedowns)
Under the Information Technology Act 2000 and IT (Intermediary Guidelines & Digital Media Ethics Code) Rules 2021, ViTuber will remove unlawful content (including copyright-infringing content) within 36 hours of receiving a valid government or court order, and within 72 hours of receiving a complaint from an affected individual.
6. Fair Use / Fair Dealing
We acknowledge that some uses of copyrighted material may qualify as fair use (US) or fair dealing (India/UK), including commentary, criticism, news reporting, education, and parody. If you believe your takedown notice was issued against a fair use, please indicate this in your counter-notice.
7. Misuse of Takedown Process
Knowingly submitting a false DMCA notice or counter-notice is a violation of law and may result in civil liability and account termination. ViTuber reserves the right to take legal action against those who abuse the takedown process.
